Michigan governor changes workers compensation legislation

Earlier this week Governor Rick Snyder signed off on a new workers compensation laws in order to repay the federal government $3 billion it owes in unemployment benefits.

However, many are criticizing the new legislation. Unemployed workers who are receiving workers compensation have only 10 weeks to find a job, even if it pays lower than their previous job and is outside their previous experience. If they decide not to take a job after 10 weeks, they could lose their benefits. This provision will make it harder for unemployed workers to collect benefits if they quit or are fired.

The only professions exempt from the new law are firefighters and law enforcement.

Man pleads guilty to workers’ compensation fraud

A man has received probation after pleading guilty to workers’ compensation fraud and filing a false report.

The 28 year-old paramedic shot himself in January but said that a man wearing a lime green jacket with NASCAR badges on it shot him. While the shooting was under investigation, the man broke down and admitted he made the story up and the wound was self-inflicted.

A judge has sentenced him to thirty-six months probation for workers’ compensation fraud and one year for filing a false report, both will be served concurrently.

Employee sues employer for $10 million

A former construction worker is suing his employer for $10 million after he lost his leg in a car accident that occurred while on the job. The man says his boss was negligent as she was driving a pickup truck and ran over him.

While his boss has taken sole responsibility for the accident and agreed that he should be awarded workers’ compensation for the accident, she believes that his compensation should be capped at $50,000 by law. The man claims he was not covered by workers’ compensation insurance and so no limit should be imposed.

He is seeking the $10 million in lost income, the extent of his injuries, medical expenses, unpaid overtime, and his wife’s emotional distress.

Iowa Bill Prevents Off-Duty Employees from Receiving Workers’ Comp

A new bill that has been approved in the Iowa House will prevent workers who are injured at the workplace while they are off duty from collecting workers’ compensation.

The bill was created after an employee of a company was given $30,000 in workers’ compensation after she was injured while running personal errands at her company. Because this case is currently under appeal by the state, some House members who are against the bill have said that they believe the bill was created solely to shorten the appeal of the previously mentioned case.

Despite the concerns of some, the bill was passed 56-36, and the bill will almost definitely have an effect on the outcome of this appeal case.

Ohio Worker's Comp Bureau admin to be named

John Kasich, the newly elected Gov. of Ohio, is expected to name state Sen. Stephen P. Buehrer to the position of administrator of the Ohio Bureau of Workers Compensation.

Kasich has a morning press conference scheduled at the Fulton County Courthouse in Wauseon, where it is expected that he will announce Buehrer as the fifth confirmed member of his cabinet.

The 43-year-old Senator has been a member of the Senate since 2007 and also served as a member of the Ohio House from 1999-2006. He is currently chairman of the Senate Insurance, Commerce and Labor Committee, which handles injured worker claims.

Massachusetts prison guard accused of workers comp fraud

A Massachusetts prison guard from Freetown pleaded not guilty in a Suffolk Superior Court last week to charges that he ran long-distance races while at the same time collecting worker’s compensation payments for an on-the-job injury he said made him unable to perform manual or strenuous labor.

The judge in the case released the guard on Tuesday on his own recognizance pending the trial date.

Prosecutors allege that the guard was injured in July 2008 while at work, and then collected about $56,000 in worker’s compensation benefits between January and March of the next year.

Authorities began the investigation this year following an anonymous tip to the attorney general’s office that the guard had run in a January 2009 marathon while receiving worker’s compensation benefits.

California vetoes new workers comp legislation

Gov. Arnold Schwarzenegger this week sided with insurers in vetoing legislation that would have forced workers compensation insurers to submit dispute-resolution clauses to the state’s insurance commissioner for review, according to a California lawmaker.

The legislation would also have required workers compensation dispute-resolution clauses to specify that California law applies in coverage disagreements involving California employers.

Currently, California law requires workers compensation insurers to submit for approval their policy forms to the insurance commissioner but does not require that side agreements be reviewed or agreed upon.

In a Sept. 30 veto message, the Governor Arnold Schwarzenegger said that the bill is unnecessary because there is no evidence a problem exists and it could reduce “the competitive market for workers compensation California now enjoys.”

“The high-deductible contract negotiations the bill seeks to impact are conducted by sophisticated participants on both sides of the table that are well-versed in all aspects of workers compensation and other insurance products.”

Fraud caught after Facebook posting

An Accord, New York woman was sentenced this week in state court for her role in defrauding her workplace for around $9,000 in undeserved workers’ compensation benefits and sentenced to three years probation, according to court documents.

The woman was accused of lying at a Workers’ Compensation Board hearing, wherein she stated that she was no working at the time that she was receiving worker’s benefit payments.

Authorities caught the woman when she bragged on Facebook about her salary and current job, where she was working while receiving benefits from her old company.



Federal workplace safety to improve by 2014

Earlier this month, President Obama signed an order telling all federal agencies to improve their workplace safety standards by 2014.  He hopes in four years if agencies work to improve safety in the workplace they can reduce the number of injuries and illness acquired on the job, reduce the amount of time spent to review a claim, and speed up an injured or ill employee’s return to the workplace.

In 2009, the federal government spent $1.6 billion on workers’ compensation and 79,000 new claims were filed by federal employees.

Federal agencies will have to pay for any improvements needed to increase employee safety standards.

Man Nearly Killed in Grain Elevator Fall, Company Ticketed

According to KIMT, “Last May, Keegan Henry, 17 of Nashua fell at least 60 feet from the top of the tallest silo at The Mill Incorporated at 102 Sample Street in Nashua.” The owner still claims he does not know what the worker was doing at the top at that time.

Now, the company has been ticketed by Iowa Occupational Safety and Health Bureau. KIMT reports, the company is being cited for “6 “serious” safety violations and proposing penalties of $5,100.

Employees took about an hour to located Henry below the empty silo. Henry is still recovering at a special center, and family members say he remains in a partial coma.

The company has not yet made a decision about whether to contest the violations.
