PA brass foundry fined $500,000 by OSHA

Posted on September 10th, 2010 No Comments

The Occupational Health and Safety Administration (OSHA) last week announced intentions to impose penalties of more than $550,000 against Excelsior Brass Works in Blandon, PA, which is owned by Kief Industries Inc.

The fines are in response to investigations that determined that the brass foundry knowingly exposed workers to lead, violating federal workplace health and safety standards.

The Assistant Secretary of Labor for OSHA stated, “The employer deliberately refused to protect workers from overexposure to lead and other workplace hazards.”

Kief Industries has been given 15 business days to respond to the penalties.

Exposure to lead is a serious workplace hazard. If you or someone you know has been the victim of negligent workplace safety standards, contact the Des Moines workers’ compensation attorneys of LaMarca & Landry, P.C. at 877-327-2600 to learn more about your rights.

Federal workplace safety to improve by 2014

Posted on July 30th, 2010 No Comments

Earlier this month, President Obama signed an order telling all federal agencies to improve their workplace safety standards by 2014.  He hopes in four years if agencies work to improve safety in the workplace they can reduce the number of injuries and illness acquired on the job, reduce the amount of time spent to review a claim, and speed up an injured or ill employee’s return to the workplace.

In 2009, the federal government spent $1.6 billion on workers’ compensation and 79,000 new claims were filed by federal employees.

Federal agencies will have to pay for any improvements needed to increase employee safety standards.

What are permanent disability benefits?

Posted on May 25th, 2010 No Comments

When employees are injured on the job, they may be able to receive workers’ compensation benefits. These benefits come in many forms depending on the nature of the injury.

If the work-related injury leads to a permanent loss of physical ability, injured employees may be able to receive permanent disability benefits. The loss of physical ability, however, does not mean that the injured worker cannot return to his or her job. Instead, workers who receive permanent disability benefits may be able to still return to their job.

Worker falls in grain silo

An Iowa grain worker was injured Wednesday after falling 60 feet to the bottom of a grain silo.

The worker was reportedly operating a grain elevator when he fell into an empty bin. He sustained injuries after hitting the concrete floor and was left unassisted for two hours until other workers found him. After being lifted out of the silo, he was taken to a nearby Waterloo hospital for treatment.

A workplace accident can lead to severe injuries that leave a worker unable to return to the job for weeks, months, or even years. If you or someone you know has been injured on the job, it is important to ensure that you receive the compensation you need to recover from your injuries and accident related costs.

What is a full commutation?

Posted on April 30th, 2010 No Comments

In a workers’ compensation case, a full commutation is a type of settlement. Under a full compensation, the victim is given a lump sum payment of all future benefits.

The risk of a full commutation is that it ends an employee’s rights to future benefits. This type of settlement, however, must be approved by the workers’ compensation commissioner.

Do you need an attorney to receive workers' compensation benefits?

Posted on April 15th, 2010 No Comments

When individuals seek workers’ compensation benefits, they are not required to hire an attorney. This means that individuals do not need an attorney to file petitions or appear before court.

However, some individuals benefit from having an attorney. Because attorneys are equipped to represent their clients best interests in legal circumstances, they can be especially helpful in complicated workers’ compensation cases.

Who chooses the medical care in a workers' compensation case?

Posted on April 8th, 2010 No Comments

When treating employees’ workplace injuries, the employer typically provides the medical care. As part of this process, the employer usually has the right to choose the medical care provider.

If an employee is not satisfied with his health care treatment, that employee can discuss the issue with his employer or the insurance carrier. If the employee is still not satisfied, he may apply for alternate medical care to the workers’ compensation commission.

If you have questions about your treatment options for workplace injuries, contact the Iowa workers’ compensation attorneys of LaMarca & Landry, P.C., at 877-327-2600.
