The difficulty of winning an age discrimination case

Older workers face the prospect of being fired because of age discrimination. When this occurs, older workers can typically sue under the Employment Act of 1967. 

However, as the result of a Supreme Court ruling in June, it will now be more difficult for older workers to win lawsuits regarding age discrimination. The Supreme Court ruling said that the burden of proof in age discrimination falls on older workers. 

After the Supreme Court decision was released, lawmakers were upset with the ruling and proposed new legislation to protect older workers' rights. That legislation, however, has not yet been passed.
