Michigan governor changes workers compensation legislation

Earlier this week Governor Rick Snyder signed off on a new workers compensation laws in order to repay the federal government $3 billion it owes in unemployment benefits.

However, many are criticizing the new legislation. Unemployed workers who are receiving workers compensation have only 10 weeks to find a job, even if it pays lower than their previous job and is outside their previous experience. If they decide not to take a job after 10 weeks, they could lose their benefits. This provision will make it harder for unemployed workers to collect benefits if they quit or are fired.

The only professions exempt from the new law are firefighters and law enforcement.

Two hurt at construction site

A man and a woman were injured after they fell nearly three stories, or about thirty-five feet, at a construction site earlier this week in the north eastern city of Titonka, Iowa.

The two were standing on a scaffolding or ladder at a grain elevator site when the accident occurred. According to the Kossuth County Sheriff’s Department, both were airlifted out of the Gold Eagle Cooperative site. Their identities as well as the extent of their injuries has not been released.

The cause of their fall is currently under investigation.

One dead at manufacturing plant

One man died and another is in critical condition after they were found unconscious at a manufacturing plant in Wisconsin.

A 55 year-old man was pronounced dead at the scene and a 65 year-old man was taken to the hospital with serious injures last month after they, investigators believe, inhaled toxic fumes while mixing two or more compounds together at the Vivid Image Inc. plant. Paramedics that arrived at the plant reported smelling a strong chemical odor.

The men are believed to have been the only two employees in the building at the time of the accident. An investigation is currently underway and OSHA is expected to conduct its own investigation as well.

Worker injured by drunk driver

A 47 year-old Des Moines truck driver, who was driving a semi truck full of mail, has been cited for drunk driving after she crashed into a construction truck in Federal Way, Washington.

The driver of the construction truck was placing lane barrels along Interstate 5 when the woman driving the semi truck collided with him. The construction truck was propelled into a parked truck as the women continued down the interstate, hitting two more vehicles.

One of the drivers in the construction trucks was injured and taken to the hospital. The damage vehicles began leaking diesel fuel and the fire department was called in to assist in clean up.

Broadway actor suffers head injury backstage

“Spider-Man: Turn Off The Lights” actor, Matthew James Thomas, suffered a head injury backstage last week in Broadway’s Foxwoods Theatre during the second act.

Thomas, who plays Peter Parker/Spider-Man during the matinee shows on Saturdays and Wednesdays, was taken to the hospital for stitches, according to the show’s producers. However, they are not saying much else. The producers claim the injury is minor and that nothing fell on his head. What exactly caused the injury has not been released.

Thomas is scheduled to return to the stage on Saturday for the next show.

This is the latest of many injuries that have plagued the Spider-Man musical. This is the fifth injury and second head injury; an actress suffered a concussion during the musical’s first preview.

Man pleads guilty to workers’ compensation fraud

A man has received probation after pleading guilty to workers’ compensation fraud and filing a false report.

The 28 year-old paramedic shot himself in January but said that a man wearing a lime green jacket with NASCAR badges on it shot him. While the shooting was under investigation, the man broke down and admitted he made the story up and the wound was self-inflicted.

A judge has sentenced him to thirty-six months probation for workers’ compensation fraud and one year for filing a false report, both will be served concurrently.

Worker killed in building collapse

A construction worker sustained fatal injuries after he was buried under six feet of bricks and debris while working on a commercial building in the Bronx.

Experts say nearly a dozen support beams gave way and caused the structure to collapse. Two construction workers were able to escape without injury. The 51 year-old man trapped under the rubble was rescued ten minutes after the collapse, but died shortly after arriving at Jacobi Hospital.

FDNY deputy chief says the employees were doing active demolition in the basement of the building when the accident occurred. However, a conflicting report states the collapse was due to a rotten beam.

Construction worker electrocuted at work

A 23 year-old construction worker is in the hospital with serious injuries after he overextended the forklift he was operating and hit a power line. A police officer was able to perform CPR and resuscitate man, who was electrically shocked.

A second construction worker was also sent to the hospital when he was injured trying to put out the fire on the forklift. He suffered minor burns and was treated at the scene. Electricity in the neighborhood and nearby school was out for remainder of the afternoon.

Emergency responders say the forklift operator was breathing on his own while he was transported to the hospital.

Employee sues employer for $10 million

A former construction worker is suing his employer for $10 million after he lost his leg in a car accident that occurred while on the job. The man says his boss was negligent as she was driving a pickup truck and ran over him.

While his boss has taken sole responsibility for the accident and agreed that he should be awarded workers’ compensation for the accident, she believes that his compensation should be capped at $50,000 by law. The man claims he was not covered by workers’ compensation insurance and so no limit should be imposed.

He is seeking the $10 million in lost income, the extent of his injuries, medical expenses, unpaid overtime, and his wife’s emotional distress.

Soldiers exposed to toxic chemical in Iraq

Nearly a thousand soldiers and civilian employees working for the Department of Defense have been exposed to the toxic substance sodium dichromate. The exposure occurred over a five month period while they worked in a water treatment plant in Iraq.

Sodium dichromate is a known carcinogen that can cause skin and breathing problems as well as cancer. The Oregon National Guard has filed a law suit against Kellogg, Brown, and Root, the contracting company that oversaw the water treatment plant. Soldiers accuse the company of knowingly exposing workers to the toxic substance, a claim KBR denies.

Many U.S. senators are pleased with the filing of the lawsuit, as many urged a federal inspector to evaluate the plant.
