			<content:encoded><![CDATA[<p>49-year old Tom Fosdick of Cedar Rapids passed away Wednesday after falling at a construction site at University of Iowa on Monday.  Fosdick was employed by Swanson Glass, who was sub-contracted to work on a construction project to restore the exterior of the University of Iowa Boyd Law Building.</p>
<p>Iowa&#8217;s Occupational Safety and Health Administration investigated the <a href="http://www.desmoinesworkerscomp.com/practice-areas/workplace-accident/">workplace accident</a> and has already fined the project&#8217;s general contractor Miron Construction of Neenah, Wisconsin $15,293 for 19 safety violations.  OSHA has six to eight weeks total to investigate the incident and determine who, if anyone, was at fault for Fosdick&#8217;s death.</p>
<p>Construction at the law school resumed on Thursday.</p>
<p>Our thoughts and prayers go out to Fosdick&#8217;s family and friends during this difficult time.</p>

			<content:encoded><![CDATA[<p>The $7 million settlement awarded to the wife of a New Jersey worker who developed mesothelioma as a result of laundering her husband’s asbestos-laden clothing has been upheld by a New Jersey Appellate Court this week. </p>
<p>Her  husband was an employee for Exxon at one of their refineries in Linden, NJ. While there, he was exposed to asbestos when removing insulation from piping. Although the company equipped the workers with helmets, it did not provide respirators, which would have protected against the asbestos.</p>
<p>This case is reminiscent of the first successful legal action taken against a company for irresponsible exposure to asbestos. In 1981, also in New Jersey, a woman sued the Union Asbestos and Rubber Company for her mesothelioma, which she developed after washing her husband’s clothes.</p>
<p>The court rejected Exxon’s counter-claim that the woman (also an ex-Exxon employee) should have been required to seek benefits under workers’ compensation.</p>

			<content:encoded><![CDATA[<p>A fatal workplace accident occurred at Sewickley Wastewater Treatment Plant leaving one plant employee killed and four more injured after they tried to help their fellow co-worker.</p>
<p>The cause of the accident is unknown, but it is thought a gas of some kind was the reason for the tragic accident. According to officials, the man was working in a 30-foot hole when he attempted to climb out, but fell backward into the hole.</p>
<p>He then radioed in that he was feeling faint and workers responded to the call. Three more employees were faint after inhaling the unknown fumes. All four people were rushed to the hospital and three were treated and released while the other was pronounced dead.</p>

<p>In 2009, the federal government spent $1.6 billion on workers&#8217; compensation and 79,000 new claims were filed by federal employees.</p>

<p>Now, the company has been ticketed by Iowa Occupational Safety and Health Bureau. KIMT reports, the company is being cited for &#8220;6 &#8220;serious&#8221; safety violations and proposing  penalties of $5,100.</p>
<p>Employees took about an hour to located Henry below the empty silo. Henry is still recovering at a special center, and family members say he remains in a partial coma.</p>
<p>The company has not yet made a decision about whether to contest the violations.</p>

<p>Reisner was hit in the head by a brace that supported a concrete wall. After the horrific <a href="http://www.desmoinesworkerscomp.com/practice-areas/workplace-accident/">construction accident</a>, &#8220;He was taken to Waverly Health Center and then transferred to the Iowa City hospital,&#8221; reports the WCF Courier. He died at the University of Iowa Hospitals and Clinics in Iowa City.</p>
<p>The funeral will be held on Wednesday.</p>

<p>According to the WCF Courier, &#8220;The wall was located between the ice cream parlor and Timmy&#8217;s Catering Service. No employees in the other business were injured.&#8221;</p>
<p>The renovated ice cream parlor is set to open next year. Officials say work will not resume until the Parlor is deemed safe.</p>

The man was an employee of Plumbing Co. and was working at 909 Northeast Chambers Parkway when the trench collapsed on him, burying him in dirt.</p>
