To work in the construction industry, one must be careful and professional. The following is a brief breakdown of the steps that should be taken to prevent injury on a construction site:

First of all, within the vicinity of the construction site, a considerable number of potential safety hazards exist, and workers are exposed to heights, harmful substances, and heavy equipment. Exercising appropriate caution at all times within the worksite is essential.

Second, moving around a construction site is a challenge in itself, for every step has the potential to result in injuries if care is not properly exercised. Making certain that the construction company provides its workers with appropriate safety gear, including work boots, is essential.

Finally, working around a construction site requires a considerable deal of skill and experience on the part of workers, as they need to be able to know what they’re doing in order to get the job done and avoid injuries. Lack of proper training can pose serious injury risks.

The dangers that usually accompany construction jobs include falls, burns, explosions due to highly flammable objects being tampered with, electrocution, asbestos exposure, and many others. In addition, over time, chronic diseases and conditions which affect the neuromuscular system can also result in serious injuries.

At LaMarca & Landry, P.C., we are committed to helping construction workers who have suffered an injury as a result of their work to get the financial assistance they need.

Workers’ compensation insurance is what employees fall back on in the event that they get injured at the workplace or while doing work-related activities. One of the oldest forms of insurance in the U.S., workers’ compensation provides financial benefits that are often extremely needed after a worker is involved in an accident that causes injury and prevents them from working, at least temporarily.

In Iowa, it is mandatory for almost all employees to be covered by their employees with workers’ compensation insurance. This is so companies rightfully ensure the safety and well-being of the people working for them. Unfortunately, workers’ compensation claims are sometimes battled by employers. Many of these employers argue that there was assumption of risk, or that the injury isn’t covered because the employee was aware that the injury is an expected outcome of doing the job; the fellow worker rule, which means that the injury is caused by a co-worker and, therefore, the blame should fall on the other person; and contributory negligence, meaning it was the worker’s fault that led to the accident.

However, the employers who try to deny workers’ compensation claims with these and other arguments are often in the wrong. In order to find out if your workers’ compensation claim was wrongfully denied, call 877-327-2600. Our legal team at LaMarca & Landry, P.C., can evaluate your claim and help you determine what steps to take next.

When Iowa Gov. Terry Branstad released his state budget proposal last month, he was not entirely clear on one key issue. That issue was workers’ compensation for nearly 20,000 union represented state workers.

Unfortunately, for union workers, this issue may not be resolved so easily. Despite the fact that there is extra money in the budget, Branstad wants to “win concessions from public sector workers.” In other words, Branstad wants these workers to pay a portion of their health control costs.

Union president Danny Homan, of Iowa Council 61 of the American Federation of State, County and Municipal Employees, believes Branstad’s actions are an attempt to weaken the union.

Iowa begins the fiscal year on July 1 with a budget surplus of almost $1 billion, $400 million of which Branstad wants to spend on tax cuts over five years.

“We’re only one of six states in the nation paying zero [for health care costs],” Branstad said. “What we’re asking is that state employees pay their fair share.”

If you have been injured and are in need of workers’ compensation benefits to pay for medical bills and other expenses, you need an attorney on your side helping. To learn more, contact LaMarca & Landry, P.C., today by calling 877-327-2600.

The Iowa Division of the Occupational Safety and Health Administration has recently cited an Iowa hog farm for four serious workplace safety violations. The company, Anogla Pork LLC, received the citation after a group of workers made a federal complaint earlier this year.

The citation states that the employers failed to make sure that the facilities were furnished in a way that they were free from hazards that could potentially cause worker injuries. The OSHA inspection took place on Sept. 19 and it was found that the power washers were improperly installed and could cause injury to workers if they were struck by the high pressure hose. Workers also claimed that they were not trained on how to use the power hoses properly.

Another violation stated that the employers failed to provide soap for them to wash their hands before eating meals and many suffered gastrointestinal illnesses that the believe is a result of working in unsanitary conditions. OSHA also found that Angola did not have a log of workplace injuries on record. They were fined a total of $3,2oo in penalties.

The Workers Compensation Research Institute published a report this week that shows one in 12 injured workers prescribed narcotics are still taking them three to six months later. The study suggests that doctors are failing to follow the recommended treatment guidelines to avoid abuse.

According to the Insurance Journal, the report revealed that the injured workers still on narcotics three to six months after their injury could lead to increased disability or work loss. Drug testing to prevent abuse and psychological evaluation were also less common than recommended.

Another study conducted in 2009 by the National Council on Compensation Insurance revealed that about a quarter of all prescription workers’ compensation costs were for narcotics.

A new study being conducted in Coralville aims to make tractors safer for children by using a tractor-driving simulator to track their movements. The leading cause of death and injury among children working in agriculture is operating farming equipment.

The program is being funded by the National Occupational Safety and Health Administration and is being conducted by researchers at the University of Iowa and the Marshfield Clinic in Wisconsin.

Cameras will track the children’s every movement and compare them to adults who are also participating in the study. Researchers are hoping to determine the differences between the children’s and the adults’ procedures and when they fully develop.

The driver attempted to jump back into the truck to stop it, but slipped out and was run over.
