Appeals Court Reverses Workers’ Comp Decision
On December 17, 2005, Jerry Tillman slipped on ice while at work and broke his wrist. His doctor told him that the wrist would not be functional again and that surgery would not help. Tillman then sought a second opinion against his employers wishes.
The second opinion led to an emergency surgery that saved Tillman’s wrist. However, when asked to cover it, the employer refused. The Deputy Commissioner for the city, the following appeal and a civil judge ruled in favor of Tillman. The employer then appealed to in the Iowa Court of Appeals where the previous decisions were reversed.
